1. Who we are

This policy applies to the website available at this domain and to related services offered by Positus Online as a meter reading and utility operations platform.

Meter reading and utility operations platform.

2. Information we collect

Depending on how you use our services, we may collect:

  • Account and service information, such as member or customer identifiers, service addresses, meter or utility-related records, and billing or account status information needed to operate the portal.
  • Contact information you provide, such as name, mailing address, email address, and mobile phone number.
  • Communications content and metadata related to emails, texts, or support requests you send or receive.
  • Technical information, such as IP address, browser type, device type, approximate access times, and diagnostic logs.
  • Location information (optional). This website may request browser geolocation to center the background map. Location is requested in your browser and is used only to display the map near you. If you decline, the map uses a default center and you can still use the site.

We collect information directly from you, from your organization or utility membership relationship where applicable, from devices you use to access the site, and from service providers that help us operate email and SMS delivery.

3. How we use information

We use information to:

  • Provide, maintain, and improve the meter reading and utility operations platform.
  • Process and communicate about accounts, billing, meters, or utility operations, as applicable.
  • Send emails for service announcements, billing notifications, and account verification when appropriate.
  • Send text messages for service announcements, billing notifications, and account verification when you have opted in or as otherwise permitted by law.
  • Respond to inquiries and provide customer support.
  • Protect security, prevent fraud or abuse, and comply with legal obligations.
  • Enforce our Terms of Use and other applicable policies.

4. Email communications (SendGrid)

We may send emails using Twilio SendGrid as our email delivery provider. Emails are used for service announcements, billing notifications, and account verification. These are transactional or relationship messages about an action or transaction you have taken or agreed to, or updates needed to operate your account or provide the service.

We identify ourselves as the sender. If we ever send non-transactional or promotional email, we will obtain affirmative consent as required by Twilio SendGrid’s Email Policy and applicable law (including the U.S. CAN-SPAM Act), include a clear unsubscribe method, include our physical mailing address, include a link to this Privacy Policy where required, and honor opt-out requests within the shorter of applicable legal deadlines or 10 days.

We retain records of email preferences and consent as needed to honor your choices and to demonstrate compliance. Privacy and support requests may be sent to the contact email listed below (the same address used for customer contact).

5. SMS / text messaging (Twilio)

We may send text messages using Twilio as our messaging provider. If you opt in to SMS, you agree to receive texts for service announcements, billing notifications, and account verification.

  • Message frequency may vary.
  • Message and data rates may apply.
  • Reply STOP to cancel.
  • Reply HELP for help.

Additional SMS program terms are described in our Terms of Use. Consent to receive texts is not a condition of purchasing goods or services where prohibited by law.

6. Mobile information and SMS consent (important)

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with any third parties, except with aggregators and providers of the text messaging services used to deliver messages (for example, Twilio and mobile carriers) as needed to operate the messaging program.

If this Privacy Policy describes other categories of information sharing, those categories exclude text messaging originator opt-in data and consent. That information will not be shared with third parties except as stated in this section.

7. When we share information

We may share information with:

  • Service providers that perform services for us, such as hosting, email delivery (Twilio SendGrid), SMS delivery (Twilio), mapping/tile providers, analytics limited to operating the service, and customer support tools. These providers are permitted to use information only to provide services to us, subject to appropriate agreements.
  • Professional advisors such as lawyers, auditors, or insurers where needed.
  • Authorities or other parties when we believe disclosure is required by law, legal process, or to protect rights, safety, or security.
  • Successors in connection with a merger, acquisition, financing, or sale of assets, subject to this policy’s protections where applicable.

We do not sell personal information. We do not share mobile opt-in data for marketing or promotional purposes as described in Section 6.

8. Retention

We retain information for as long as needed to provide the services, maintain account and billing records, comply with legal and regulatory obligations, resolve disputes, enforce agreements, and keep proof of messaging and email consent until consent is withdrawn or longer if required by law.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Cookies and similar technologies

This site may use cookies, local storage, or similar technologies that are necessary for basic operation, security, or preferences. The background map may load map tiles from third-party mapping services (such as OpenStreetMap). Those providers may receive technical request data such as IP address when tiles are fetched.

11. Your choices

  • Location: You can allow or deny browser geolocation prompts.
  • Email: Use the unsubscribe link in non-transactional emails, or contact us.
  • SMS: Reply STOP to opt out; reply HELP for help.
  • Account information: Contact us to update or correct information we maintain.

Transactional or relationship emails and certain service messages may still be sent when needed to operate your account or fulfill legal obligations, even if you opt out of marketing.

12. U.S. privacy rights

Depending on where you live, you may have rights under state privacy laws (for example, the California Consumer Privacy Act as amended by the CPRA) to request access to, correction of, or deletion of certain personal information, or to opt out of certain sharing.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. To make a privacy request, use the contact details below. We will verify requests as required by law and respond within applicable timelines.

13. Children

This website and related services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us and we will take appropriate steps to delete it.

14. Changes

We may update this Privacy Policy from time to time. The updated version will be posted at this URL with a revised “Last updated” date. Continued use of the site or services after an update means you acknowledge the revised policy, except where additional consent is required by law.
